These Terms & Conditions ("Terms") are a legal agreement between you ("you" or "the user") and Aperon Labs, the studio of Haseeb Manzoor (sole proprietor) ("we", "us", "our"), the provider of the WallSplash mobile application for iOS and Android (the "App", package id com.wallsplash.app). WallSplash lets you detect the colour of a wall using your device camera and returns an approximate HEX code, a closest-named paint colour, harmonious palettes, paint-mixing guidance and a Light Reflectance Value (LRV), and lets you preview colours in a styled room and via a custom colour picker. The App also includes the WallSplash Helper questionnaire, a paint & colour news feed, a "paint stores near you" feature, and on-device colour history and favourites. The App is free to use and does not require an account, login or sign-up. Please read these Terms carefully. If you do not agree, do not use the App.
By downloading, installing, accessing or using the App, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the App and should uninstall it.
You must be of the legal age required to form a binding contract in your country of residence to use the App. The App is not directed at children, and its advertising content rating is set to PG. If you are using the App on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.
Your use of the App may also be subject to the terms and rules of the app store from which you downloaded it (for example, the Apple App Store or Google Play). Those store terms are between you and the relevant store provider; where they conflict with these Terms in relation to your download, the store terms govern that download relationship.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use one copy of the App on a device that you own or control, solely for your own personal, non-commercial use.
You may not, and may not permit anyone else to: copy, modify, adapt, translate or create derivative works of the App; reverse engineer, decompile or disassemble the App or attempt to derive its source code, except to the limited extent that applicable law expressly permits despite this restriction; rent, lease, lend, sell, sublicense, distribute or otherwise commercially exploit the App; remove, obscure or alter any copyright, trademark or other proprietary notices; use the App for any unlawful purpose or in any way that infringes the rights of others; or interfere with, disrupt, or attempt to gain unauthorised access to the App or any systems or networks connected to it.
All rights not expressly granted to you in these Terms are reserved by us and our licensors.
The App and all of its content, including its software, source code, design, user interface, graphics, text, colour-matching logic, named-paint-colour data and naming, palettes, logos and the WallSplash name and branding (together, the "Content"), are owned by or licensed to Aperon Labs and are protected by copyright, trademark and other intellectual-property laws.
Nothing in these Terms transfers any ownership of the App or the Content to you. The licence in Section 2 does not give you any rights in our trademarks, trade names or logos. Third-party content made available through the App (for example, OpenStreetMap map data, news articles and advertisements) remains the property of its respective owners and is provided under their own terms, as described in Section 5.

Certain features rely on third-party content that is subject to separate copyright and attribution requirements. In particular, paint-store and map data is © OpenStreetMap contributors and is made available under the Open Database Licence (ODbL); see Section 5 for details. Where the App displays content from news publishers, that content remains the copyright of those publishers.
The App relies on several third-party services to provide certain features. We do not control these services and are not responsible for their content, availability, accuracy or practices. Your use of features that depend on them may also be subject to the relevant third party's own terms and privacy policies.
Location and paint stores near you: The App does not use GPS. To estimate your city for the "paint stores near you" feature, it sends your IP address to third-party IP-geolocation providers (ipwho.is, with ipapi.co as a fallback) and receives an approximate city and coordinates, which are cached locally on your device. Detection happens once and is reusable; you can manually re-sync up to three times in Settings.
Map and store data: Paint stores are queried from OpenStreetMap's Overpass API using your approximate coordinates. Map and store data is © OpenStreetMap contributors and is licensed under the Open Database Licence (ODbL). Only coarse coordinates are sent; no other personal data is sent for this purpose. Store listings are provided for convenience only and may be incomplete, out of date or inaccurate.
News feed: The paint & colour news feed is fetched from public RSS feeds operated by third-party design publishers (for example, Dezeen, Design Milk and Apartment Therapy). Tapping a story opens it in an in-app web view on the publisher's website. The articles are the property of, and the responsibility of, those publishers, and we do not endorse or verify their content.
Advertising and Google: The App is supported by advertising served through Google AdMob / Google Mobile Ads, which may include banner, interstitial, app-open and rewarded ad formats. Your use of advertising features is subject to Google's terms and policies. See Section 6 for more detail.
Over-the-air updates: The App uses Expo Updates to download JavaScript updates from Expo's servers. By using the App you consent to it downloading and installing such updates automatically.
The App is free and is funded by advertising. Ads are served by Google AdMob and may appear as banners, interstitials (full-screen ads shown between actions), app-open ads and rewarded ads. To serve and measure ads, the Google ad SDK may collect information such as your device Advertising ID, approximate (IP-based) location and device and usage information.
If you are in the EEA or the UK, a Google User Messaging Platform (UMP) consent form is presented so you can make choices about personalised advertising. You can review and change your ad-privacy consent at any time in the App's Settings. The App is not directed at children: tagForChildDirectedTreatment is set to false and the ad content rating is set to PG.
We are not responsible for the content of third-party advertisements, the products or services they promote, or any websites or apps they link to. Any dealings you have with advertisers are solely between you and the advertiser.
The App is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, to the fullest extent permitted by law. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, satisfactory quality, title and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that defects will be corrected.
Colour detection and matching are approximate. Wall-colour detection uses on-device image analysis (k-means clustering), and results — including HEX values, the closest named paint colour, palettes, paint-mixing guidance and LRV figures — are estimates only. They are affected by factors we cannot control, such as ambient and artificial lighting, white balance, your device's camera and screen, screen calibration, surface texture and finish, and the limits of colour reproduction on screens. Named-paint matches are approximations and are not affiliated with, endorsed by, or verified against any paint manufacturer's official product.
Do not rely on the App for purchasing or professional decisions. The App is provided for general informational and inspirational purposes only and is not a substitute for professional advice or for physical colour verification. Before buying paint or making any colour-dependent decision, you should obtain and review official physical colour samples (such as manufacturer swatches or test pots) from the paint supplier. We make no guarantee that any colour shown in the App will match real-world paint, lighting or surfaces, and we give no professional, colour-accuracy or fitness-for-purpose warranty of any kind.
Some jurisdictions do not allow the exclusion of certain warranties or of statutory consumer rights, so some of the above exclusions may not apply to you. Nothing in these Terms limits or excludes any rights you have that cannot lawfully be limited or excluded.
To the fullest extent permitted by law, Aperon Labs and its directors, employees, agents and licensors will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, data, goodwill or anticipated savings, arising out of or in connection with your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.
Without limiting the above, we are not liable for any loss or damage resulting from: inaccurate colour detection, named-colour matches, palettes, LRV figures or paint-mixing guidance; any purchasing or design decision you make based on the App; the content, accuracy, availability or practices of any third-party service, including IP-geolocation providers, OpenStreetMap/Overpass, RSS publishers, Google ads and Expo; or any third-party advertisements or linked content.
To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the App or these Terms will not exceed the greater of (a) the total amount you paid us, if any, to use the App in the twelve months before the event giving rise to the claim (which, as the App is free, is likely to be zero), or (b) ten US dollars (USD 10).
Some jurisdictions do not allow certain limitations or exclusions of liability, so some of the above may not apply to you. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
To the extent permitted by law, you agree to indemnify, defend and hold harmless Aperon Labs and its directors, employees, agents and licensors from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with: your use or misuse of the App; your violation of these Terms; or your violation of any law or of the rights of any third party in connection with your use of the App.
Your use of the App is also governed by our Privacy Policy. In summary, and as described more fully there: photos analysed for colour detection are processed entirely on your device and are not uploaded, sent to any server or stored beyond a transient local sample used for analysis; colour history and favourites are stored locally on your device only (in AsyncStorage) and are never uploaded; and we operate no server-side database of users. Because no personal data is collected on our servers by WallSplash itself, there is no developer-held personal data for us to delete — you control all local data on your device and can remove it by clearing your history or the App's data.
Certain features do send limited information to third parties as described in Section 5 (your IP address to IP-geolocation providers, coarse coordinates to OpenStreetMap/Overpass, and advertising-related data to Google). All network requests made by the App use HTTPS and are encrypted in transit.
These Terms apply for as long as you use the App. You may end this agreement at any time by ceasing to use the App and uninstalling it from your devices.
We may suspend, restrict or terminate your access to the App or any of its features at any time, with or without notice, including if you breach these Terms or if we discontinue the App or any feature. We may also modify or discontinue the App, or any part of it, at any time.
Termination does not affect any provisions that by their nature should survive, including those relating to intellectual property, disclaimers, limitation of liability, indemnity and governing law. On termination, the licence granted in Section 2 ends and you must stop using the App.
We may update these Terms from time to time, for example to reflect changes to the App, its features or third-party services, or to comply with legal requirements. When we make changes, we will update the "Effective date" at the top of these Terms and make the revised version available within the App or on our website.
Changes take effect when posted. Your continued use of the App after the revised Terms become effective means you accept the updated Terms. If you do not agree to the changes, you should stop using the App and uninstall it.
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of Pakistan.
You agree that the courts of Lahore, Pakistan will have exclusive jurisdiction to settle any such dispute or claim, except where applicable mandatory consumer-protection law in your country of residence gives you the right to bring proceedings, or requires that they be brought, elsewhere.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
These Terms (together with the Privacy Policy) are the entire agreement between you and us regarding the App and supersede any prior agreements on that subject. You may not assign or transfer these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, reorganisation or sale of assets, or by operation of law.
